Waiver and Release of Liability - Version 1.1

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.
In consideration of being allowed to enter, observe, and/or participate in activities at Treasure Valley Escape Rooms, LLC (“TVER,” “we,” “us,” or “our”), I agree to the following:
1. Acknowledgment of Activity
I understand that an escape room is an interactive, timed entertainment experience that may involve themed environments, puzzles, props, sound effects, lighting effects, fog effects, locked or controlled-access doors, physical movement, bending, crouching, reaching, stairs or changes in flooring, and other similar features.
I understand that participation may involve inherent risks, including but not limited to:
- slips, trips, and falls;
- collisions with walls, doors, props, fixtures, or other participants;
- cuts, scrapes, bruises, splinters, or minor physical injury;
- stress, anxiety, fear, or panic caused by game themes, dim lighting, confined-feeling spaces, time pressure, sounds, fog, or other theatrical effects;
- aggravation of pre-existing medical, physical, emotional, sensory, or mobility-related conditions; and
- damage to or loss of personal property.
2. Voluntary Participation
I understand that participation is voluntary. I choose to participate knowingly and freely and accept full responsibility for my participation.
If at any time I feel uncomfortable, unsafe, ill, overwhelmed, or unable to continue, I understand it is my responsibility to stop participating and notify a staff member immediately.
3. Health and Ability to Participate
I represent that I am physically and mentally able to participate safely. I understand that some game experiences may include dim lighting, sudden noises, theatrical effects, fog, confined-feeling spaces, time pressure, and other features that may not be suitable for every person.
I understand that I should not participate, or should stop participating immediately, if I have any condition that may make participation unsafe for me or others, or if I become dizzy, lightheaded, panicked, short of breath, disoriented, or otherwise unable to continue safely.
4. Agreement to Follow Rules and Staff Instructions
I agree to follow all posted rules and all instructions from TVER staff at all times. I understand that unsafe behavior, horseplay, vandalism, intoxication, refusal to follow instructions, or intentional misuse of the facility or props may result in removal from the premises without refund.
I understand that I must not climb on, force, strike, tamper with, remove, or otherwise misuse props, fixtures, doors, furniture, walls, ceilings, locks, or equipment unless clearly instructed to do so as part of gameplay.
5. Assumption of Risk
I understand and acknowledge that participation in escape room activities involves inherent risks, both known and unknown. To the fullest extent permitted by law, I voluntarily assume all risks of injury, illness, emotional distress, property damage, or other loss arising out of or related to my entry onto the premises or participation in any activity at TVER.
6. Release and Waiver of Liability
To the fullest extent permitted by law, I, on behalf of myself and my heirs, personal representatives, assigns, and anyone acting on my behalf, release, waive, and discharge Treasure Valley Escape Rooms, LLC, and its owners, members, managers, employees, contractors, volunteers, agents, affiliates, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or related to my participation, presence on the premises, or use of the facility, including claims arising from the ordinary negligence of any Released Party.
This release does not apply to any liability that cannot be waived under applicable law.
7. Personal Property
I understand that TVER is not responsible for lost, stolen, or damaged personal property, except as otherwise required by law. I assume responsibility for any personal belongings I bring onto the premises.
8. Damage to Facility, Props, or Equipment
I understand that escape room sets, props, fixtures, puzzles, and equipment are custom-built and may be fragile, expensive, or difficult to replace. I agree to treat the facility and all game elements carefully and to use them only as intended.
I agree that I may be held financially responsible for damage caused by my intentional misconduct, reckless behavior, vandalism, or failure to follow posted rules or staff instructions. I understand that TVER may remove any participant from the premises without refund for such conduct.
9. Emergency and Medical Care
If I experience an injury, medical issue, or emergency during participation, I authorize TVER staff to secure appropriate assistance, including emergency medical services if deemed necessary. I understand that I am solely responsible for any medical costs incurred on my behalf.
10. Photography and Video Recording
I understand that TVER and others authorized by TVER may photograph, video record, or otherwise capture images, audio, or likenesses of participants in or around the facility during participation.
I grant TVER the right to use my name, image, voice, appearance, and likeness in photographs, video, or other recordings taken in connection with my visit for lawful business purposes, including advertising, marketing, promotional materials, social media, website content, and related uses, without compensation or further approval.
I understand that all such photographs and recordings may be owned and used by TVER.
11. Severability
If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12. Entire Agreement and Interpretation
This Agreement is intended to be interpreted as broadly as permitted by applicable law and constitutes the full understanding between me and TVER regarding liability related to my participation, except for any separate written agreement signed by TVER.
13. Acknowledgment
I certify that:
- I have carefully read this Waiver and Release of Liability;
- I understand its contents;
- I understand that I am giving up certain legal rights by signing it;
- I am signing voluntarily and of my own free will; and
- I am not relying on any oral statement or representation inconsistent with this Agreement.
